Terms and Conditions
Welcome to the DeerBlinds.net Web site. Please review
the following terms and conditions (the “Terms and Conditions”)
concerning your use of, and purchase of products through, this site.
By using this site, including downloading materials or purchasing
or accepting products, you (“Customer”) agree to these
Terms and Conditions. DeerBlinds.net reserves the right to change
these Terms and Conditions from time to time at its sole discretion
without notice. These Terms and Conditions apply to all visits to
the DeerBlinds.net Web site, both now and in the future. Therefore,
please check these Terms and Conditions carefully each time you
place an order with or accept delivery of any products from DeerBlinds.net.
These Terms and Conditions (along with any related Deerblinds.net
invoice(s)) represent the entire understanding relating to the use
of the DeerBlinds.net Web site and purchase and sale of any products
through such site, and these Terms and Conditions shall prevail
over any prior or contemporaneous, conflicting or additional, communications.
Any attempt to alter, supplement, modify or amend these Terms and
Conditions by Customer will be considered a material alteration
of these Terms and Conditions and, therefore, are null and void.
All references herein to Deerblinds.net shall also include its owner,
Napier Advisory Services LLC. These Terms and Conditions were last
updated on March 8, 2007.
DeerBlinds.net Satisfaction Guarantee
Deerblinds.net offers our customers a 14-day satisfaction
replacement or refund guarantee on all purchases, as described in
these Terms and Conditions. To take advantage of Deerblinds.net’s
satisfaction guarantee, Customer must comply with the Product Return
Procedure detailed in Section 3 below. Any breach of Deerblinds.net's
Product Return Procedure will result in the loss of Deerblinds.net's
refund/replacement guarantee. Furthermore, all return shipments
not in compliance with these instructions will be rejected.
Product Return Procedure
- Return Material Authorization (RMA): Contact
DeerBlinds.net at admin@DeerBlinds.net to obtain a Return Material
Authorization (RMA) number which allows Deerblinds.net to keep
track of the return. Without an RMA number, Deerblinds.net will
not accept a returned shipment. RMA numbers must be requested
within 14 days of merchandise delivery. RMA numbers will not be
extended or reissued.
- Product Condition: The returned product must
be in new and unused condition, in the original box with all the
documentation, parts and accessories to insure full credit. The
RMA number should be written on the outside of the returned package
to allow successful processing. “New and unused” means
re-sellable condition, not dirty and not altered. We cannot accept
returns for an item with any indications that it has been used.
If any component of the returned product is missing, DeerBlinds.net
may in its sole and absolute discretion reject the entire return
or choose to impose additional charges against the Customer for
replacement of the missing component(s).
- Return shipping costs and Restocking Fee: Customer
is solely responsible for return shipping costs unless the item
is damaged or defective. Customer agrees to use only reputable
carriers capable of providing proof of delivery and insurance
for the entire value of the shipment. Customer agrees to bear
all shipping and insurance charges and all risk of loss for the
return product during shipment. DeerBlinds.net will not refund
to Customer the original shipping charges. In addition, all returns
are subject to a 30% restocking fee and must be returned (i.e.,
postmarked) within 2 weeks (14 days) after receiving the item.
If you have any questions about the restocking fee as it pertains
to your order, please call us before we ship the product to you.
Payment Terms: Orders
An order is not binding upon DeerBlinds.net until it is accepted. DeerBlinds.net must receive payment before it will accept an order. Payment for product(s) ordered is due prior to shipment. Customer can make payment by credit card, or some other method prearranged with DeerBlinds.net. You agree to pay the amount(s) due as specified on the invoice, and you agree to pay interest on all past-due sums at a rate of 1.5% per month or the highest rate allowed by law, whichever is greater.
Shipping Charges
Your total cost for purchase of any product will include shipping and handling charges shown on the DeerBlinds.net invoice.
Title; Risk of Loss
DeerBlinds.net will arrange for shipment of ordered product(s) to the Customer, Free On Board (F.O.B.) shipping point, meaning title to the product(s) and risk of loss passes to the Customer upon delivery to the carrier. DeerBlinds.net reserves a purchase money security interest in the product(s) until its receipt of the full amount due. Customer agrees to allow DeerBlinds.net to sign appropriate documents on Customer's behalf to permit DeerBlinds.net to protect its purchase money security interest. DeerBlinds.net will advise Customer of estimated shipping dates, but DeerBlinds.net will, under no circumstances, be responsible for delays in delivery, and associated damages, due to events beyond its reasonable control, including without limitation, acts of God or public enemy, acts of federal, state or local government, fire, floods, civil disobedience, strikes, lockouts, and freight embargoes.
Trademarks
DeerBlinds.net, the DeerBlinds.net logo and design, are registered trademarks or trademarks (the "Marks") of DeerBlinds.net. in the United States and/or other jurisdictions. Customer is not permitted to use the Marks without the prior written consent of DeerBlinds.net. All other marks and names mentioned herein may be trademarks of their respective companies.

Governing Law and Jurisdiction
Any dispute arising out of or related to these Terms and Conditions or the sales transaction between DeerBlinds.net and Customer shall be governed by the laws of the State of Texas, without regard to its conflicts of law rules. Specifically, the validity, interpretation, and performance of these Terms and Conditions shall not be governed by the United Nations Convention on the International Sale of Goods. DeerBlinds.net and Customer consent to the exclusive jurisdiction and the exclusive venue of the State Courts of the State of Texas, Travis County, to resolve any dispute between them related hereto, and the parties waive all rights to contest this exclusive jurisdiction and venue of such Courts. Finally, the Customer also agree not to bring any legal action, based upon any legal theory including contract, tort, equity or otherwise, against DeerBlinds.net that is more than one year after the date of the applicable invoice.
Severability
If any provision contained in these Terms and Conditions becomes invalid, illegal, or unenforceable in whole or in part, such invalidity, illegality, or unenforceability shall not affect the remaining provisions and portions of these Terms and Conditions, and the invalid, illegal, or unenforceable provision shall be deemed modified so as to have the most similar result that is valid and enforceable under applicable Texas law.
Waiver
The failure of either party to require performance by the other party of any provision of these Terms and Conditions shall not affect in any way the first party's right to require such performance at any time thereafter. Any waiver by either party of a breach of any provision in these Terms and Conditions shall not be taken or held by the other party to be a continuing waiver of that provision unless such waiver is made in writing.

Please allow us 10-14 days once we have received your

Damaged or Defective Items
Unfortunately, accidents happen....If your order arrives
at your door damaged, broken or defective, we will either replace
the broken parts or ship out a new replacement order, depending
on the circumstances.
Requests for replacement parts will be processed as
quickly as possible. Please note that we may not be able to express
ship replacement pieces.

DeerBlinds.net will provide a replacement order or a refund for
your damaged, incomplete or incorrect order, if the issue
is reported within 14 days of receiving the order.
We work hard to make your shopping experience at DeerBlinds.net

with questions about warranties on a specific manufacturer.
Credit and Return Time
Please give us some time to process your return/exchange.
It takes about 10 business days for us to receive the returned or
exchanged product back from you. Within 72 hours of receiving the
item back in our warehouse, you will receive an e-mail that reflects
that your credit card has been credited.
All refunds granted are for the purchase price of
the product only and can only be issued to the credit card used
at purchase.
Canceling Your Order
If you have placed an order and would like to cancel
it, please call us at 1-512-535-5890 within four hours of placing
your order to cancel it free of any charges.
Don't worry! Even after the four hours, our friendly
customer service will do all that we can to stop the items from
being processed and/or shipped but there is no guarantee that we
will be able to stop it in time.
DeerBlinds.net Privacy Policy
We will never sell any customer's information to any
third party. This is our pledge to you, our customer. Any information
gathered on this site will be used only by DeerBlinds.net. One month
after your order is placed, your credit card information is automatically
deleted from our database. Your privacy is our first and
main concern. We understand that you want to be able to purchase
deer blinds and hunting products online and not have to give away
your personal information to do so.
